Terms of Service

1. Acceptance of Terms

By accessing or using DecoTech CRM ("we," "us," or "our"), including all associated services, integrations, and APIs (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users of the Service, including workspace administrators, team members, and any person who accesses content through the Service.

2. Accounts & Workspaces

To use the Service, you must create an account and, optionally, a tenant workspace. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

  • You must provide accurate and complete information during registration.
  • You must be at least 18 years old or the age of majority in your jurisdiction.
  • Workspace administrators are responsible for managing user access and ensuring their team members comply with these Terms.

3. Permitted Use

You may use the Service for lawful business purposes, including managing customer relationships, sending communications, scheduling social media posts, and integrating with supported third-party platforms.

You agree not to:

  • Use the Service to send unsolicited or unlawful communications (spam), or violate any applicable telecommunications law including the TCPA.
  • Attempt to gain unauthorized access to any part of the Service or other users' data.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use the Service in a way that could damage, disable, or impair the platform or interfere with other users' use.
  • Resell, sublicense, or redistribute the Service without our prior written consent.

4. Third-Party Integrations

The Service allows you to connect third-party accounts, including but not limited to:

  • Google Gmail — for reading and sending emails. Your use of Gmail data through our Service is subject to the Google API Services User Data Policy, including the Limited Use requirements.
  • Twilio — for SMS messaging and phone number management.
  • Meta (Facebook & Instagram) — for social media account management and post scheduling.
  • Intuit QuickBooks — for accounting data synchronization.

By connecting a third-party account, you authorize us to access and use your data from that service as described in our Privacy Policy. You are responsible for complying with each third-party service's own terms and policies.

5. Your Data

You retain ownership of all data you upload, enter, or generate through the Service ("Your Data"). By using the Service, you grant us a limited license to host, process, and display Your Data solely for the purpose of operating and improving the Service.

We do not sell Your Data to third parties. We do not use Your Data for advertising or marketing purposes unrelated to the Service. For details on how we handle your information, see our Privacy Policy.

6. Security

We implement industry-standard security measures, including AES-256-GCM encryption for sensitive credentials, HTTPS/TLS for data in transit, and multi-tenant data isolation. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

You are responsible for maintaining the security of your account credentials and for promptly notifying us of any unauthorized access.

7. Payment & Billing

Certain features of the Service may require a paid subscription. If you subscribe to a paid plan:

  • You agree to pay all applicable fees as described at the time of purchase.
  • Subscriptions automatically renew unless you cancel before the renewal date.
  • Refunds are handled on a case-by-case basis at our discretion.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, engage in abusive behavior, or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. You may request deletion of your data in accordance with our Data Deletion Policy.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the actions, content, or data of third-party services you connect.

10. Limitation of Liability

To the maximum extent permitted by law, DecoTech CRM and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless DecoTech CRM from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Florida.
